1. Nature of the Service (Curated Archive, Not Employment Roster)

1.1 Independent Archive: CMSG is a curated public directory and academic archive showcasing registered Chinese medicine practitioners in New Zealand.

1.2 No Employment or Agency: Inclusion in this directory does not constitute employment, partnership, joint venture, or agency with Hapai Kura Clinic Ltd.

1.3 Independent Practice & Scopes: All featured practitioners are independently registered with the Chinese Medicine Council of New Zealand (CMCNZ) under the Health Practitioners Competence Assurance Act 2003 (HPCA Act). Practitioners holding the CM Specialist scope (cm-specialist) are listed for academic and archival record only and do not provide patient consultations through this website. Bookable practitioners (specialist-consultant and cm-expert) provide clinical care under their own individual professional registration and clinical accountability at the affiliated clinic.

2. Medical & Emergency Disclaimer

2.1 Informational Purpose Only: All content published on this website—including clinical articles, scope overviews, practitioner spotlights, and case reports—is provided solely for general educational, academic, and informational purposes. Nothing on this website constitutes clinical advice, medical diagnosis, or the establishment of a practitioner-patient relationship.

2.2 Emergency Services: This website and its inquiry forms do not monitor or respond to clinical emergencies. If you are in New Zealand and experiencing a medical emergency, immediately dial 111 or attend the nearest hospital emergency department.

3. Bookings and Third-Party Transactions

3.1 Clinical Appointments: Patient bookings are facilitated through an embedded interface or external link provided by ManaNotes (mananotes.co.nz), an independent third-party scheduling service. Consultations booked via ManaNotes are subject to the independent clinical terms, fees, and cancellation policies of the attending practitioner and Hapai Kura Clinic Ltd.

3.2 Course Registrations of Interest: Any course, seminar, or continuing professional development (CPD) section on this site records expressions of interest only. Submitting an intent form does not create an order, reserve a guaranteed seat, or constitute an educational contract. Early-bird registrations, invoicing, and payment processing are fulfilled exclusively by third-party educational providers (such as NZTCM). CMSG does not collect payments or process payment orders on this website.

4. Intellectual Property & Acceptable Use

4.1 Proprietary Rights: All visual identity assets, editorial layouts, custom code, and practitioner profiles on this site are the intellectual property of CMSG, Hapai Kura Clinic Ltd, or their licensors.

4.2 Restrictions: You must not scrape, extract, or republish practitioner imagery, professional biographies, or editorial publications without express prior written consent.

5. Limitation of Liability & Governing Law

5.1 Limitation: To the maximum extent permitted under New Zealand law (including the Fair Trading Act 1986 and Consumer Guarantees Act 1993, where applicable), CMSG and Hapai Kura Clinic Ltd disclaim all warranties, express or implied, regarding site uptime, directory completeness, or third-party scheduling availability. We shall not be liable for any direct, indirect, incidental, or consequential losses arising from the use of this website.

5.2 Governing Law: These Terms are governed exclusively by the laws of New Zealand. Any disputes arising in connection with this site shall be subject to the exclusive jurisdiction of the Courts of New Zealand (Auckland Registry).
